Terms of Service

By downloading, installing, or using Nowly (the browser extension, Nowly Host, website, and any associated software), you unconditionally agree to these Terms of Service. If you do not agree, please do not use the software.

Nowly is a free, open-source tool that detects media content in your browser and automatically updates your Discord status (Rich Presence) via local communication with the Discord client. The service consists of:

• A Chromium browser extension that detects and reports your activity.
• A Nowly Host that acts as a gateway to Discord.
• A website for discovering and installing presences.
• A developer SDK and tooling for creating custom presences.

The service is intended for users aged 15 or older.

Nowly is distributed under the Business Source License 1.1 (BUSL-1.1). You may use, copy, and modify it for personal, non-commercial purposes; any commercial use (resale, offering it as a paid or hosted service) requires a separate commercial license. On the Change Date, the license automatically converts to MIT. The full text is available in the GitHub repository. This license does not apply to content from third-party platforms (YouTube, Twitch, etc.) that you choose to display via Nowly.

You agree to use Nowly in compliance with applicable laws and Discord's Terms of Service. You must not:

• Use Nowly to display illegal, hateful, defamatory, or rights-infringing content.
• Attempt to bypass the security mechanisms of the extension or Nowly Host.
• Distribute modified, forged, or unsigned presences through the official infrastructure.
• Use Nowly in a way that violates the terms of Discord or any platform you access.
• Send abusive automated requests to the API.

If you configure a custom API URL (self-hosted instance), you are solely responsible for the third-party server you target. Nowly's Privacy Policy does not apply to servers you host or configure yourself.

The service is and will remain entirely free. Donations via Ko-fi are purely voluntary and grant no additional features or benefits. Payments are processed by Ko-fi under their own terms. Donations are non-refundable.

The Nowly source code is subject to its open-source license. All third-party trademarks, logos, and platform names (Discord, YouTube, Twitch, Disney+, Apple TV+, Prime Video, TikTok) remain the property of their respective owners. Nowly is not affiliated with, endorsed by, or sponsored by Discord Inc. or any supported platform.

Nowly is provided "as is", without any warranty, express or implied. To the extent permitted by law, the publisher shall not be liable for indirect damages arising from the use or inability to use the software, including:

• Malfunction of Discord or your status display.
• Suspension or restriction of your Discord account by Discord Inc.
• Loss of data stored locally by the extension.

Nothing in these terms excludes or limits liability for fraud, gross negligence, personal injury, or any case where the law prohibits such limitation. These clauses do not affect mandatory consumer rights.

Your use of Nowly is governed by our Privacy Policy and Cookie Policy, both of which form part of these Terms of Service.

The publisher reserves the right to modify these Terms at any time. Changes take effect upon publication on this page. Continued use of Nowly after changes are posted constitutes acceptance of the updated terms.

These Terms are governed by French law. In the event of a dispute, and failing amicable resolution, French courts shall have jurisdiction, subject to mandatory consumer protection rules. The EU online dispute resolution platform is also available.
